Subject: Comments on the “Rocket Docket” of Victim Disarmament Legislation

Honored Members of the Committee:

First, I am writing to say that some of the legislation under consideration by the committee is not properly labelled as “gun control.” Gun control constitutes the safe, proficient, and proper use of a firearm — the four safety rules, stance, grip, sight alignment and picture, breathing, trigger operation, target selection, etc.

Rather, the legislation in question (HB 8, HB 40, HB 83, HB 87, HB 130) is more properly called “victim disarmament,” in that the people most likely to be affected by it are the people who have the most reason to own and carry firearms for self-defense — the little old lady or the paraplegic who lives alone in a bad neighborhood, the five-foot-nothing 100-pound woman being stalked by a six-foot 200-pound deranged ex-boyfriend.

The bad people (the criminals, terrorists, and violence-inclined mental defectives) whom the proponents of this legislation say will be disarmed by it most likely will not be affected in the least. If they want access to a firearm, they will have it, by hook or by crook.

You see, the bad guys have found this massive loophole in the existing restrictions on private civilians’ rights to own and carry weapons called “breaking the law.”

There are already 20,000 to 25,000 existing restrictions upon the pre-existing individual, civil, Constitutional, human right to own and carry weapons, which are supposed to be guaranteed against State infringement by the Second Amendment and Article 2, Section 6 of the State Constitution. None of these anti-liberty statutes has stopped a bad guy from obtaining a firearm when they want it.

Laws already exist that prohibit felons, domestic abusers, foreign terrorists, incurable drug abusers and alcoholics, and mental defectives from obtaining, owning or carrying firearms.

Laws already exist that prohibit the use of firearms (and other objects) to harm other people (murder, assault with a deadly weapon, etc.).

I think it’s safe to say that all these laws have done is keep honest people honest, the same way locks on doors do.

Those who propose further infringements upon individual liberty aren’t truly looking to improve the human condition at all, but seeking more power over others for whatever reasons. No good will come from these infringements — no good has ever come from these sorts of laws, and no good ever will.

Specifically —

House Bill 8[3], so-called “universal background check” legislation sponsored by Representative Debra Sarinana, would ban all private firearms sales between law-abiding individuals. Gun owners will be forced to pay undetermined fees and obtain government approval before selling firearms to family members, friends, neighbors and co-workers, or fellow hunters, competitive shooters and gun club members. This proposal will have no impact on crime and is unenforceable without gun registration. [4]

House Bill 40[5], by Representative Miguel Garcia, would require criminal records checks on private firearms sales at gun shows — a perennial target of the gun control crowd, even though studies show that these events are not a source of crime guns.[6]

House Bill 83[7], extreme risk protection order or “red flag” legislation sponsored by Representative Damon Ely, would authorize the seizure of firearms and ammunition from individuals without due process. Unchallenged statements made by a petitioner before a judge, alleging that someone is a danger to themselves or others in an ex parte proceeding — prior to any formal court hearing at which the respondent can be represented by counsel and present counter evidence — would be sufficient for law enforcement to enter that person’s home and confiscate their private property.[8]

House Bill 87[9] by Representative Deborah Armstrong expands the state’s “prohibited person” firearm law by purportedly incorporating federal firearm disqualifications. The bill would prohibit individuals convicted of certain domestic violence misdemeanor crimes or who are subject to a domestic violence protective order from purchasing or possessing a firearm, with violations being a criminal offense. However, the bill goes beyond the prohibited categories in federal law in several significant ways. The state law definition of “household member” — unlike federal law — specifically includes a person who is or has been a continuing personal relationship, which applies to dating or intimate partners who have never lived together. The bill would include, as firearm-prohibiting offenses, nonviolent misdemeanors with no physical contact between the parties (like harassment by telephone or email, or criminal damage to the property or jointly owned property of a “household member”). Unlike federal law, this bill would require anyone subject to a protective order to surrender any firearms they own, possess, or control to law enforcement within 48 hours of the order. Not only does this bill impose a mandatory surrender, it authorizes law enforcement to seize any guns that are in plain sight or are discovered pursuant to a lawful search. Similar legislation had passed the Legislature in 2017 but was vetoed by Gov. Susana Martinez. Significantly, the 2017 legislation contained other options for affected parties to comply with the firearm surrender requirement, including storing their guns with licensed firearm dealers, or transferring the guns to a qualified third party. These key alternatives are not contained in this bill.[10]

House Bill 130[11], sponsored by Representative Linda Trujillo, would make gun owners criminally and civilly liable if a child gains unsupervised access to an unsecured firearm. New Mexico already has a first degree felony child abuse statute on the books to hold adults accountable for putting children’s lives or health at risk in any manner. The tools exist to charge and prosecute parents or guardians in appropriate cases. Education is the key to protecting gun owners and their kids, not a state mandate on how one stores a firearm in his or her home.[12]

If you truly want to stop violent crime and terrorism, find out what motivates criminals and terrorists to hurt others, and address those concerns.

A Response to the Socialist Just-Us Worriers

“We are fighting to end hate, to unite as one and love each other. We are fighting to be treated right without discrimination and for everyone to have equal opportunities.”

Bullshit. You have no quantifiable metrics for injustice, so you have no victory conditions (for a very simplified example, when blacks hold X% of all engineering jobs and are only Y% of all prisoners, racism is ended). That would be fine by itself, but you believe in fighting injustice with injustice (gays have historically been denied gay marriage? let’s get random CEOs fired for opinions they held six years ago). You don’t seek converts, you seek to punish and bully — straight white males who disagree with you must be purged and publicly humiliated. Even the jihadists will spare you if you convert; no apology or future correction will satisfy a SJW.

I could forgive that too if you weren’t all hypocrites and liars. Your treatment of women and minority dissenters is appalling; if they don’t want you acting on their behalf, that’s their choice, not “internalized patriarchy” or whatever. You rob them of moral agency. When called out for these behaviors (as you always insist on calling out others), you lie. You strawman your opponents (criticized a woman? misogynist!), you group them with the worst (you’re a gamer? you’re as bad as the anonymous rape threateners!) and when confronted with your own flaws, you restate them less threateningly (motte and bailey argument). You phrase all arguments as kafkatraps (disagreeing with your assertion that we are evil is taken as proof that we’re evil). You publish manipulated and misleading statistics, then lambast anyone who questions them.

You insist on vigilante justice against random acts of the week for your two-minutes hate. Why is it the NFL’s business to punish domestic violence? And, if it is their business, why isn’t Hope Solo receiving the same attention from your side?

Then you claim to be arguing for equality, but you’ve taken the idea of racism (hatred based on skin color is bad) and replaced it with a new concept where only one race can be guilty of racism. You excuse racial prejudice and hatred based on what I’ve already explained are arbitrary, unmeasured states of being. Your solution for the unequal treatment of whites and blacks is to hold whites to a higher standard. Your side lobbied the FBI to redefine rape so more women victims would be counted, but also so that “made to penetrate” does not count, leaving male victims in the cold. Because male privilege, apparently.

Historically ignorant SJWs think whites hold collective guilt for the awful things our ancestors have done. But they don’t care about the unspeakable atrocities by other races. The only difference between whites and others was that whites had the social and technological prowess to do evil efficiently; Africans, Asians, Indians, and everyone else practiced genocide and slavery, they were just less adept at doing it right. Given the means, they would have done the same. But nope, only whites are guilty; Arab oppression of blacks and caucasians never happened, not to us, nope.

I’ve been lucky enough to grow up in America, so this shit is new to me. But I’m descended from puritans, and I know my history; I know how they treated dissent. I also know how commies treated dissent; I grew up next door to a grizzled old Russian who barely avoided the gulag by smuggling himself out of the country. I know what you petty tyrants have turned into every time you gained enough power.

Worst of all, you turn the very principles of freedom against us. We tolerate you because we believe in free speech and civil discourse, not bullying and violence. But that means we have to watch you advocate against that very freedom. We don’t believe in ruining a stranger’s professional life over an opinion, but that means that we can’t punish your actions.

We believe that the rightness of our actions should speak for itself. You believe in bullying, even as you claim to love the oppressed.

Funny how the evil and all-powerful patriarchy has seen fit to act according to SJW whims for all of recent memory, punishing those they hate and protecting those they love. Funny how the evil oppressor males have to speak anonymously, while the SJWs fighting the power can use their real names and get mainstream media coverage for fun and profit. How when a million straight white male nerds get bullied, no one cares, but the minute one fag hangs himself, suddenly bullying matters — and the solution, of course, is more bullying, but by the “right” people.

That’s the arrogant core of it. You do the same evil, in the same pattern, as so many before you, because mob justice, punishing dissent, and repression of others is just fine and dandy so long as the “right” people are doing it to the “wrong” people.

Eat shit and die. All I ever asked was to be left alone.

No, I didn’t write it.

However, I agree one hundred percent, so I’m reposting it here.

Also, I’ve previously been slandered or libeled as being a racist (I’ll admit I’ve considered litigation). Racism sucks. So does being falsely accused of being a racist.

Finally, for those wondering why I refer to these pukes as “Socialist Just-Us Worriers” instead of the “conventional” moniker of “social justice warriors,” from what I’ve seen from them —

  1. “Socialist” — Have you ever heard any of them stick up for individual liberty, or the laissez-nous-faire free market? Neither have I.
  2. “Just-us” — Actual justice isn’t on the agenda. What is on the agenda is making the world and everyone in it inoffensive to them and theirs.
  3. “Worriers” — Trying to picture these people as ANY sort of actual combatant as is usually meant by the word “warrior” makes my head hurt.

An open letter to Ladd Everitt at CSGV

Mr. Everitt –

As we all have noticed, you have a rather disconcerting obsession with the penises (penii?) of firearm owners and are constantly comparing them to the size of those who do not own guns. This particular fetish for penis size comparison is quite interesting, very much so to be honest. With that in mind we’d like to ask you a few questions.

  1. How long have you been meat gazing?
  2. Do you also compare the dick size of minors who enjoy guns?
  3. Is your comparison based on erect or flaccid penises?
    1. If erect to you give out a handie before measuring?
    2. If you give a handie do they get a happy ending or do you leave them with blue balls?
  4. Do you go “hands on” or just guesstimate?
  5. Do you ask to check penis size or do it surreptitiously?
  6. How many dicks have you measured over the years?

Considering your penis fetish, as displayed on your Facebook page, we feel these are valid concerns. We are most concerned with question #2 as most of our sons also enjoy the shooting sports and the fact you are checking out their dick size is rather troubling. As a matter of fact there is a word that describes adults who groove on checking out the genitalia of children.

Anyway we await the answers to our queries and thank you for your cooperation.

Coverup in the Bernalillo County GOP [1]

Over the past ten days the Republican Delegates to the State Pre-Primary Convention have been flooded with stories and rumors of what took place at the Bernalillo Pre-Convention Meeting on February 5th, 2014.

In order for our party to be unified in defeating Tom Udall, we are releasing all documents pertaining to the events of February 5th, with an understanding of how those events took place and how people have been pressured to change their stories to benefit the Weh campaign.

We hope that after reading these materials you will come to your own conclusion as to whether any wrongdoing occurred at the Bernalillo Pre-Convention Meeting, or the events that transpired following that night.

What Occurred On February 5th?

Three days prior to the Pre-Convention Meeting, the Bernalillo rules committee met and changed the county rules to allow “those that could not attend the convention due to weather be allowed to be voted upon as a delegate by those attending the event.”

New Mexico State Rules, which supersede any county rules declare that any rule change must occur at least 28 days prior to any county convention, and the Clements campaign was notified of this change only an hour prior to the start of the convention. (1) (2) (3)

Any challenge to this ruling was required to be made no later than one hour before the start of any county convention, which happens to be the exact time that the Clements campaign was informed of the rule change.(4)

The second, and more egregious, error made by the county committee involves the election of at large delegates.

After delegates were nominated and elected by each ward of Bernalillo county, 30 delegate positions were still available to be elected to the state convention. Past convention precedent clearly shows that these “at-large” delegates are to be elected from the pool of unelected delegate nominees remaining in person at the county convention. Instead, they were elected from a list of non-present persons provided to the meeting by Diego Espinoza, Allen Weh’s own campaign manager. (4)

Throughout this process the ballots were “secured” by none other than the treasurer for Allen Weh’s campaign, and “ballot counters” were actually Allen Weh staff members who were even wearing campaign materials. (5) (6)

What Was Done To Correct Any Wrongdoing?

By the deadline to contest the decision, February 10th, multiple protests were submitted to the chairman of the Bernalillo County Republican Party, Frank Ruvolo. (7) (21)

A decision on the issue was returned later on February, 10th. He had decided that the at-large delegates were improperly placed and would be removed from the Bernalillo slate. (8)

This decision was aided with input from Dr. Charles Tipton, and input from State Republican Chairman John Billingsley. (9) (10)

The matter seemed to be put to rest until Chairman Ruvolo suddenly reversed his decision citing “long discussions” and reseating the at-large delegates. (11)

How the Clements Campaign Responded

On February 17th, David Clements released an open letter to Allen Weh informing him of what had occurred, and sought the opportunity to work together to find an equitable solution to what happened in Bernalillo County. (12)

Later on February 17th Diego Espinoza responded to David Clements claiming that no protests had been filed and that David’s letter was a stunt. David Clements quickly responded. (12)

After this email was sent, emails were circulate from Frank Ruvolo, Dr. Charles Tipton, and Chairman John Billingsley seemingly denying that they had ever provided testimony or decisions that would call into question the events of February 5th. (13) (14)

Chairman Billingsley even emailed every delegate in response to Clements’ open letter. (15) (16)

What Happened Next?

The latest in this series of events occurred on February 21st, when the Clements campaign email account was hacked by a staff member of the Allen Weh Campaign.

Diego Espinoza, the Weh campaign manager, abused the Clements email system and used it to resend the open letter to multiple delegates. (17)

Mr. Espinoza willingly did this numerous times, and some delegates received over 8 copies of the open letter to Allen Weh.

The Clements campaign went to their Internet service provider to find out why delegates were receiving multiple copies of the open letter. They were provided with a link that identified Mr. Espinoza as having willingly forwarded the email in excess of 500 times. (18) (19) (20)

There is no question that Diego Espinoza acted with ill intent in regards to David’s open letter to Allen Weh.

How many times have we, the advocates of the right to own and carry weapons, heard this from the hoplohpobes and victim-disarming hypocrites:

We’ve been hearing it quite often from all corners of the victim-disarmament crowd – mostly from the useful idiots who carry water for this evil, stupid brand of insanity (“I don’t like guns, therefore no else should have any”), but also from their legislative buddies, the same buddies who often have armed bodyguards in close proximity.

Below is a clip taken from an interview that Senator Dianne Feinstein gave to CBS’ 60 Minutes in 1995. In this clip, the Senator stated that her intention with the 1994 Clinton-era “assault weapon” ban was to require everyone to turn them all in to the federal government:

Feinstein is one of the hypocrites in that she’s had a concealed-weapons permit herself, as well as armed bodyguards from the California Highway Patrol (remember the TV series CHiPs?) assigned to her personally.

What I would like to know is when she’s going to have those CHP officers assigned to her protection detail report to Sacramento for other duties? When is she going to surrender her concealed-weapon permit?

After all, if she were honest and had any integrity, she wouldn’t have any problem rendering herself as defenseless as she wants to render everyone else.

What about the UNMH Shooter? [CNM Dissent]

UNM North Campus Situation: Active Shooter at UNM. There is no imminent threat at CNM properties. No further information is available at this time. Please refer to local news outlets for information on street closures.

For those not “in the know,” the phrase “Active Shooter” means someone who carries their gun(s) into a venue where people are present and starts shooting people. These “Active Shooters” usually pick places to do this where everyone else in the vicinity has been disarmed by the venue’s rules and regulations. Other examples: Virginia Tech, Ft. Hood, in that on most college campuses and military posts, the carrying of firearms or “other weapons” is forbidden to everyone except those who have official permission. CNM[1] and UNM[2] have such policies.

When was the last time you heard of one of these incidents happening at a shooting range, or at a gun show? You would think that places with lots of armed people present would have blood on the floor a foot deep. But no, those are some of the safest places I’ve been to in my life, and – get this! – everyone is polite to everyone else. Whodathunk it?

CNM Main Campus is on lockdown temporarily due to UNMH suspect at-large. CNM Security personnel will notify occupants of change in status.

So CNM went on “lockdown” for an incident that happened over a mile away from CNM’s facilities?! What was this clown carrying, a Barrett M82 variant?!

Even IF he had been carrying some sort of .50-caliber rifle[3], he wouldn’t have been able to hit much of anything at CNM with it, considering that there’s all kinds of these things called buildings in the way. Also consider that even with a rifle chambered in .50 BMG, you still have to be a decent shot to hit CNM property from the UNMH location – there is, after all, about 1.5 miles between the two.

Whew! Aren’t we lucky that such an incident didn’t happen at CNM? After all, the administrators haven’t gotten their plan together to deal with such incidents yet:

CNM should consider adding School Shooter planning to their Emergency Management Plan (EMP), and consider a joint training exercise in the future with the Albuquerque Police Department (APD), APD Special Weapons and Tactics (SWAT) units, Bernalillo County Sheriff’s Office (BCSO), hospitals, and other agencies and organizations as appropriate.

The college has instituted Emergency Management Training, which when fully implemented will be mandatory training of all CNM employees. This training contains three modules, Active Shooter, Emergency Evacuation, and Disruptive Students. Additionally, the college has included a SWAT/APD Active Shooter Drill on the Two Year Safety and Security Calendar. The college is planning an Emergency Response Team Exercise conducted by APD during the Fall 2010 term, and a full drill scheduled for 2011.

I’m wondering – what will this “Active Shooter” module to the Emergency Management Training consist of, besides the admonition to lock the door and a revival of the Cold-War era “doctrine” of “duck and cover”?

Y’know, CNM could save a bundle on “expert” panels and seminars if they would simply strike the prohibition against armed students, faculty and staff[1] and let people go about their business armed. Think of the saved costs in terms of electricity not used for PowerPoint shows.

Hell, CNM could even make a few bucks off of this, by offering courses in self-defense and firearms safety and proficiency.

    • Never bring firearms or other weapons on premises, including buildings, parking lots and vehicles.
    • Fascination with guns or other weapons may indicate an employee at risk for violent behavior. Carefully consider such situations and, if appropriate, report it to your supervisor.
  2. 2. Violent Behavior

    Violent behavior will not be tolerated.

    • Violent behavior includes verbal, written, physical, electronic, or non verbal threats or other behavior that would constitute a threat of violence or cause a reasonable person to be fearful.
    • Violent behavior includes physical acts against persons, University property, or property belonging to others that would constitute a threat of violence or cause a reasonable person to be fearful.
    • Violent behavior includes restraining an individual or interfering with someone’s free movement, except in patient care or child care areas when specifically authorized by departmental policy.
    • Violent behavior includes the possession or use on University property of firearms, ammunition, or weapons of any kind, unless authorized for law enforcement personnel by the University Chief of Police. This also includes brandishing any object that could reasonably be perceived as a weapon. The University’s policy on weapons is listed in Section 2.1. below. [Emphasis mine – MWB]
    • Violent behavior includes the use or possession on University property of dangerous substances or materials, explosives, or incendiary devices, unless used for University business, such as research, and specifically authorized in advance by Safety & Risk Services.

    2.1. Weapons Prohibited on University Property

    Law enforcement officers, in the performance of their authorized duties, may carry weapons on campus. ROTC students conducting required and supervised drills may carry inoperable weapons only for the purpose of those drills.

    With the foregoing exceptions, no person may use or possess a weapon on any part of campus. For the purpose of this policy, weapons include, but are not limited to, firearms, ammunition or other dangerous weapons, substances, or materials, bombs, explosives, or incendiary devices. Persons with such weapons, materials, or devices must enter campus at the closest point to the Campus Police Office and deposit all weapons or materials at that office for the duration of their stay. Dangerous substances and materials used for University business, such as research, must be authorized in advance by Safety & Risk Services.

    If any person does carry such weapons and/or materials on campus, the weapons and/or materials may be impounded by a law enforcement officer for the duration of the person’s stay on campus and the person may also be subject to appropriate disciplinary and/or criminal action.

  3. Chances are the firearms this clown carried were NOT anything chambered in .50 BMG, but something smaller and lighter, that’s easier to walk around the UNMH corridors with.
